Registration and purchases will be processed on the following terms and conditions. When You apply for registration or place an order for a game entry, you(referred to in these Terms and Conditions as “You” or “Customer”, and “your” has a corresponding meaning) agree to be bound by these Terms and Conditions.
AUTHORITHY AND LICENCING

Our organisation (referred to in these Terms and Conditions as “We” or “Us”, and “our” has a corresponding meaning) is licenced, authorized and regulated in Darwin by the Government of the Northern Territory of Australia. This website is operated, and sales to Players are made, under and in accordance with the licence issued by that authority.
GENERAL TERMS & CONDITIONS
  1. Customers wanting to register are required by Law to be 18 years or older. Proof of age will be requested.
  2. The information You supply in registering as a Customer must be true and correct. Account Information supplied will need to be verified and must include a valid email address, residential address and contact phone number.

    Any information which is untrue, incorrect or misleading will result in the immediate cancellation of your Account. We may also cancel any purchase by You and suspend and/or exclude You from any further purchases. Any remaining account balances will be returned to You as long as no transaction fraud has taken place, and net of any costs incurred.

    This Website and any related internet sites or material accessible via this Website (“Digital Assets”) operate under a strong Know Your Customer policy, and upon registration as a Customer, You are bound by that policy.
  3. You register as a Customer when your request to register is accepted by Us, or We accept any payment for purchases from You. Players may only register one account. Multiple accounts will be identified and merged or suspended where necessary.
  4. Players must register themselves personally.
  5. Players must update their account details to keep their current residential address, email and telephone contact details up to date.
  6. We strictly prohibit the transfer of accounts to any other persons in any form, either by sale or any other means, and any attempt to do so will result in the cancellation of the account.
  7. We prohibit the transfer of funds between player accounts for any reason.
  8. We will purchase your entries as your agent, not as principal. Entries are purchased on your behalf. This clause does not apply where your order is for a game entry in a Foreign Lottery. For those entries, refer to the clauses below under “ENTRIES IN FOREIGN LOTTERIES”.
  9. The amount charged which is not directly attributable to the actual cost price of the entry represents a service charge to cover all the costs of administering your order, holding entries on your behalf, keeping computer records of your numbers, notifying You of your prizes and collecting those prizes on your behalf.
  10. We will make best efforts to fulfil your order as requested. However, in the event of any failure to purchase your entry, whether for reason of force majeure, delay, electronic interference or error by Us or Our employees or agents, We are liable only for the amount of money paid for the entry.
  11. Your order and payment are accepted where Our bank account is kept, and is only accepted when funds are cleared and deposited to the account.
  12. In the event of a Customer suffering any loss or damage as a result of any unlawful act of an employee, servant, agent, or contractor , or any accredited representative or other party, or as a result of any fire, flood, tempest, storm, riot, civil commotion, lockout, strike, equipment failure for any reason, or electronic tampering, any liability to the Customer shall be limited to the cost of the Customer’s purchase in the particular transaction involved.
  13. You acknowledge that You use this website at your own risk. To the fullest extent permitted by law, We exclude any liability to You (in contract, tort or in any other way) for any loss or damage You may claim to suffer as a result of your use of this website, or your use or reliance on any information, products or services provided by Us through this website. We do not accept any liability for any indirect or consequential loss or damage of any kind (including loss of data, loss of profits or expectation profits), whether to You, your employees, servants or agents or any other person.
  14. All winners should check their local tax obligations.
  15. Customers should satisfy themselves that any applicable local laws are complied with. We accept no liability due to any failure by You to comply with any applicable local laws. Without limiting this, residents of the United States of America are not eligible to play or register.
  16. All prize amounts are published in Australian Dollars unless otherwise expressly stated, and paid in Australian dollars or the equivalent foreign currency applicable at the time of payment. Jackpot amounts are correct at the time of publishing but may vary from drawing to drawing.
  17. Total prize pools are estimated from previous prize pools but may vary in future.
  18. We will endeavour to adopt the best business practice in all Our business.

ACCOUNT SECURITY

  1. You will be required to nominate an Account password, when making a registration for an account application.
  2. Your correct email address and password will be required to access your account.
  3. It is your responsibility to ensure that You keep safe and do not disclose your password or account sign in details to others person. You will be responsible for any and all use of your Account. We do not accept any liability to You due to any failure by You to maintain the safety and confidentiality of your password or account sign in details.
  4. All transactions are passed through a secure server using the latest 2048-bit RSA / 256-bit SSL (secure sockets layer) encryption technology. 2048-bit RSA / 256-bit SSL encryption is the current industry standard.

PURCHASES

  1. Purchases can only be made through the website.
  2. Purchases can only be made via a Customer Account.
  3. When You confirm a purchase on "Checkout" You are confirming your order purchase selected by You on these Terms and Conditions, and You authorise Us to debit your Account.
  4. Where insufficient funds are held in the account to cover a purchase, an option to deposit funds will be provided.
  5. Purchases can be made directly off account balance if the account has sufficient funds. We will seek to make the purchase from account balance first in all instances. Account balances are comprised of player deposits from Your nominated payment sources, and from winnings deposits.
  6. Cumulative Purchases of more than $500AUD will invoke an automated verification request for a Customer to be verified. If the Customer is verified but is using a new payment source, this payment source will need to be verified
  7. Purchases must be received by the website computer system prior to the cut-off time for the relevant draw(s). The cut-off time for each Australian Lottery draw is as published on the Website from time to time. All published times are Australian Eastern Standard Time unless otherwise specified. The cut-off times for draws in the following games are set out below. They are correct at the time of publication of these Terms and Conditions:

  8. If a Purchase is not received or processed by the cut-off time for a draw the purchase will be processed for the next available draw for the lottery purchased.
  9. All winnings are subject to verification procedures before payment will be credited to your account.
  10. The outcome of purchases by You in any draw will be determined in accordance with:

    • The Rules of the Lottery in which the purchase was made; and
    • (subject to that), these Terms and Conditions.

ENTRIES IN FOREIGN LOTTERIES

  1. Under our licence issued by the licensing authority, we are licensed to sell entries matched with the Nominated Foreign Lotteries listed under clause 7 in the section “PURCHASES” above.
  2. Where your order is for a game entry in a Nominated Foreign Lottery:
    • we will ensure that game entries are placed in the Foreign Lottery chosen by You, which match the game entries which You have ordered; and
    • your accepted order will entitleYou to an amount equivalent to any winnings on the matched tickets in the Foreign Lottery, subject to the payment of any applicable taxes and external collection expenses; and
    • we will ensure that all winnings on those matched entries are collected, applied and used only to make payment of any applicable taxes and external collection expenses and to pay to You an amount equivalent to the winnings on those matched game entries.
  3. References to tickets in these Terms and Conditions refer to tickets in the Foreign Lottery unless the context requires otherwise.
  4. The above clauses apply in addition to all the other clauses in these Terms and Conditions.

PRICING POLICY, CURRENCY

  1. All of Our Product prices are in the currency shown on the website (Euro, British Pounds or Australian dollars (AUD)), and Product prices are regularly updated when price changes are received from Our suppliers.

REFUNDS

  1. Please choose carefully. We do not normally give refunds if You simply change your mind or make a wrong decision.
  2. Once an order is confirmed after the “checkout” process, the order is deemed final and cannot be cancelled or amended. However, for autoplay and long-term subscriptions, cancellations for credit to your account can be made on a pro-rata basis.
  3. All tickets are officially lodged into the main systems of the lottery operator, and once this lodgement has taken place, Customers cannot exercise any discretion to cancel or refund, regardless of the time to the drawing of that game.
  4. Please contact Customer Service for any errors You may believe to have occurred with your account.

DEPOSITING FUNDS

  1. Deposits can be made to your player account by using any of the payment methods available on the website.
  2. To deposit funds use the Make a Deposit link in your player account.
  3. Deposits can only be used for purchases once they are confirmed as “cleared funds” in Our bank account.
  4. Cumulative Deposits of more than $500AUD will invoke an automated verification request for a Customer to be verified. If the Customer is verified but is using a new payment source, this payment source will need to be verified.
  5. We are not a financial institution and are unable to pay interest on deposits or account balances held in Customer accounts.

WITHDRAWING FUNDS

  1. Withdrawals will only be processed on the Website, using the withdrawals screen on the player account menu. No verbal or other requests will be processed.
  2. In compliance with the Anti-Money Laundering (AML) rules in operation with this website:

    • Only winnings may be withdrawn and only back to an identified source. Deposits can only be used for purchases, and cannot be withdrawn to other accounts.
    • Refunds will only be deposited to bank accounts associated with the credit or debit card used to make deposits to the player account.
    • Cumulative withdrawals of more than $500AUD will invoke an automated verification request for a Customer to be verified. If the Customer is verified but is using a new payment source, this payment source will need to be verified.
    • Withdrawals to sources outside the verified credit, debit card or payment service will need to be verified as belonging to the Account holder before any transfer can take place.
  3. Payment to You can be made by the following methods namely Direct Credit, Electronic Transfer or Cheque. Any charges applicable will be applied to the account balance. Please note direct credits or electronic transfers usually take from 24 to 48 hours, depending on the location of your bank. Exchange fluctuations may vary the amount transferred. Exchange rates are set by the banking institution on the day of the transfer.
  4. Cumulative withdrawals of more than $500AUD will invoke the automated verification request for a customer to be verified. If the customer is verified, but is using a new payment source, this payment source will need to be verified.
  5. Withdrawals to sources outside the verified credit card or payment service will need to be verified as the Account holders before any transfer can take place.
  6. Payment to You can be made by the following methods Direct Credit, Wire Transfer or Cheque. Any charges applicable will be applied to the account balance. Please note direct credits or wire transfers usually take from 24 to 48 hours, depending on the location of your bank. Exchange fluctuations may vary the amount transferred. EMAIL COMMUNICATION

  1. All customers are required to provide a valid email address as part of the registration process. This email address serves as both the primary account login and the email for which all customer communications are delivered. Customers may change their email address by contacting customer service and providing adequate verification of account ownership.
  2. Email receipts of all purchases, transaction deposits or withdrawals, game results and winnings notifications applicable to products purchased by a Customer, will be sent to the registered email address. Customers cannot unsubscribe from the above emails as they are classed as integral communications to the operation of your account on the website, and serve as a record of transactions. Online versions are also stored on the account and can be viewed by the Customers at any time.
  3. Any changes to the Terms & Conditions of the website will also be communicated via the primary email associated with the customer account.
  4. Any security or account issues will also be communicated via the primary email associated with the customer account.
  5. Marketing and Promotional emails can be unsubscribed from, and settings to determine the subscription level to these emails can be adjusted by the customer in their account management settings on the website.
  6. Account inactivity emails will be sent to customers who have a remaining balance when the inactivity period is reached.

ANTI-MONEY LAUNDERING (AML)

  1. We operate a high standard of AML procedures. All Customers upon registering and accepting these Terms and Conditions are subject and bound by the Anti-Money laundering policy set out on the website.

CLOSURE OF ACCOUNT

  1. Customers may close their account at any time by advising customer service in writing or email, telephone closures are not permitted.
  2. On the closure of an account provided that your details are correct, We will remit to You the account funds balance, less applicable costs, fees and charges. This does not override any rights We have pertaining to the handling of your account elsewhere in these Terms and Conditions.
  3. If there have been no transactions by You on your Account for a continuous period of 12 months (Inactive Account), We will charge your Account with an account maintenance fee of $5.50 per month (including GST) from the time of the last transaction and for as long as your Account remains Inactive. This fee represents the reasonable costs incurred by Us in maintaining your Account throughout extended periods of inactivity.
  4. We will cease charging an account maintenance fee if You transact your Account, if You instruct Us to close your Account, or if your Account has a zero balance.
  5. In the event of a Member's death, the balance of the Member's Account will automatically form part of the deceased Member's estate. Claimants will be required to supply proof of entitlement in order for funds to be transferred.
  6. Customers who wish to enquire about inactive or closed accounts will be required to supply proof of identity used to open the account.

RESTRICTED COUNTRIES

As part of our strict terms and conditions of our licence, and with respect to the laws of each country, where that country has a law that prohibits online gambling, we are unable to register customers and allow game play from that country.

GOVERNING LAW AND JURISDICTION

  1. The law of the Northern Territory, Australia governs these terms. You and We submit to the jurisdiction of the courts of the jurisdiction in which this licence was issued.

ASSIGNMENT

  1. Your use of this website is personal to You and You may not assign any rights in connection with this website or any rights under contracts arising from the use of this website. We may assign any rights on this website. If so, We will notify You by a notice on this website.

OTHER RIGHTS

  1. You may reproduce or display the material on this website only in its unaltered form and only for your personal, non-commercial use.
  2. We do not grant You a licence to use any of the trademarks appearing on this website.
